What Can a California Landlord Do When a Tenant Abandons the Rental?
You can end the lease without going to court, but not by changing the locks. Once rent has gone unpaid for at least 14 consecutive days and you reasonably believe the tenant is gone, California lets you serve a Notice of Belief of Abandonment, and the lease ends 15 days after it's handed over or 18 days after it's mailed unless the tenant answers in writing. Anything they left inside then needs its own notice to reclaim before it gets hauled.

Is It Abandoned?
How Do You Know a Tenant Has Actually Abandoned the Rental?
In California, 2 things have to be true: rent has been due and unpaid for at least 14 consecutive days, and you reasonably believe the tenant has left for good.
Unpaid rent alone isn't abandonment. Neither is an empty driveway for a week. What usually builds a reasonable belief is several signs together: utilities shut off at the tenant's request, mail stacking up, keys left on the counter, most of the furniture gone, or a neighbor who watched them load a moving truck.
Be careful with the units that only look abandoned. A tenant in the hospital, deployed, or on a long trip can come back to a unit you've already turned over, and that's a lawsuit. Write down what you saw and when, and photograph it.
The Notice
What Is a Notice of Belief of Abandonment?
It's the written notice California Civil Code section 1951.3 lets a landlord serve to end a lease when a tenant appears to have abandoned the property, without filing an eviction case.
The statute gives the wording, and California's courts post a fill-in version of the Notice of Belief of Abandonment form. It tells the tenant that rent has been unpaid for 14 consecutive days, that you believe they've abandoned the property, and that the lease will end on a date you fill in: no earlier than 15 days after the notice is handed to them, or 18 days after it's mailed.
The landlord or the landlord's agent can give it, so your property manager can handle it. Send it to the tenant's last known address, plus any other address where you think they'll actually get it, and keep proof of when it went out.
If They Answer
What Happens If the Tenant Writes Back Before the Deadline?
If the tenant sends a written notice before the termination date saying they don't intend to abandon the property, along with an address where they can be served by certified mail, the unit isn't abandoned under California law and the lease doesn't end.
At that point you're back to the normal eviction process: a notice, a court case, and a sheriff lockout if you win. The California Courts eviction guide lays out those steps, and our eviction cleanout page covers the haul at the end of it.
The statute also lists facts a tenant can prove later to show the property wasn't abandoned, including that rent hadn't actually been unpaid for 14 straight days when the notice went out, or that they paid some of the rent during the notice window. If any rent comes in, stop and talk to your attorney.
What They Left
What About the Furniture and Things They Left Inside?
Ending the lease doesn't make the tenant's belongings yours; in California they still need a separate written notice to reclaim, with at least 15 days if delivered in person or 18 if mailed, before anything gets hauled.
That notice comes from Civil Code section 1984. If you believe what's left is worth less than $700, the notice can say it may be kept, sold, or destroyed if nobody claims it in time. Worth $700 or more, and it goes to a public sale.
Our guide on what to know before starting an eviction cleanout covers storage, labeling, and sorting belongings from trash, and the same rules apply to an abandoned unit.
Timeline
How Long Does It Take to Get an Abandoned Rental Back on the Market?
If both notices go out by mail one after the other, count on about 50 days from the first day of unpaid rent before the unit can be cleared in California: 14 days of unpaid rent, 18 days on the abandonment notice, and 18 more on the reclaim notice.
| Step | Handed over in person | Mailed |
|---|---|---|
| Rent due and unpaid | 14 consecutive days | 14 consecutive days |
| Notice of Belief of Abandonment | 15 days | 18 days |
| Notice of right to reclaim belongings | 15 days | 18 days |
| Earliest the unit can be cleared | About 44 days | About 50 days |
Those are minimums, assuming each notice goes out the first day it can. Your attorney may handle the two notices differently, and a partial rent payment during the window can undo the abandonment notice.
The days add up against the rent. Divide the monthly rent by 30: a $2,400 unit is about $80 a day sitting empty, which is why the haul should be booked for the day after the reclaim window closes, not the week after.
Paperwork
What Should You Keep in the File Along the Way?
Keep 5 things, starting the first day you suspect the Temecula rental is empty: the rent ledger, your notes, both notices with proof of delivery, and dated photos.
- ✓The rent ledger showing 14 or more consecutive days unpaid.
- ✓Your notes on why you believed the tenant was gone, with dates.
- ✓A copy of the Notice of Belief of Abandonment and proof of personal service or mailing.
- ✓A copy of the notice to reclaim, with a list of what was stored and where.
- ✓Photos of the unit before anything moved, and again after any repairs or cleaning you'll deduct from the deposit.
That last set matters for the deposit. Since April 1, 2025, under AB 2801, California wants photos before and after any repairs or cleaning you deduct, and our guide to move-out photos for California landlords explains the rule.
Clearing the Unit
Who Clears the Unit Once Both Windows Close?
A two-person Wild West crew does, starting at $195 for a quarter load in Temecula, Murrieta, or Menifee, and most weeks we're at the unit within 24 to 48 hours of your text.
The ladder runs $195 for a quarter load, $350 for a half, $495 for three-quarters, and $595 for a full 12-yard trailer. Stairs add $150 on loads under 7 cubic yards or $300 on loads of 7 or more, fridges and AC units are $30 each, and mattresses are $15. Text photos to (951) 837-8072 and you get a load size and a firm price before we roll out. We let ourselves in with a lockbox code, so you don't have to drive over.

An abandoned unit is the one job where I'll tell a landlord to wait on us. The notices take a few weeks, and doing them right keeps you out of a dispute over what happened to someone's things.

FAQ
What Else Do Landlords Ask About Abandoned Rentals?
No. Rent has to be due and unpaid for at least 14 consecutive days before the notice can go out, and you have to reasonably believe the tenant has left. A week late is just late rent, and the normal eviction process applies.
Handing it over in person gets you the shorter window, 15 days instead of 18. Mailing adds three days but is often the only option when nobody answers the door. Either way, keep proof of when it went out.
No. Until that date passes without a written answer from the tenant, the lease is still in effect. Changing the locks or moving someone new in early is the kind of self-help California's courts warn landlords about.
Not the same one. Commercial leases have their own version, Civil Code section 1951.35, which ties the notice to the rent default in the lease instead of the 14-day count. Leftover property in a commercial space has its own reclaim rules too, starting at section 1993.
Yes. The security deposit rules still apply, so the itemized statement goes out within 21 days after you get the unit back, with photos if you're deducting for repairs or cleaning.
Either one. The court form's wording covers the landlord or the landlord's agent, so a property manager can sign it and serve it.
